Why does my 13 week old lab keep pooping in the kitchen?

we have a 13 week old black lab puppy. We are crate training him to aid with housebreaking him. He can hold his pee and poo all night long and when we let him out he goes #1 and #2 immediately outside at the same time each morning and the same routine when we come home from work. But almost without fail, about the 3rd time we let him outside, and then back in within 5 minutes he either pees or poos on the kitchen linolieum. What are we doing wrong? Should we confine hime to the crate whenever he is inside? That would seem kinda cruel, but I would try it if it works. We really want to have him trained so he can be more part of the family and sleep in our bed with us. HELP!!
Just to clarify some things... we do not leave him in his crate for an overextended amount of time and when he is outside there is no need for a leash (wide open spaces). Also when he is outside it is usually for hours.

get a leash ant put it on him and leave it in reach when he tries to go to another room yank the leash if he tries to poo or pee yank the leash i promise he will get the idea
